LEGAL ADVICE AND GUIDANCE

Shiva Samui development offers a safe and secure structure of ownership for buying your new luxury villa in Koh Samui. We have over 10 years experience of assisting investors and owners to realise the dream of owning their very own piece of paradise and achieve this with a combination of ownership and freehold all double secured with a back-to-back lease.

Structure In Thailand it is permitted for anyone to own the building, and therefore the structure of the villa is owned outright by yourselves, your company or a pension fund.

Land Shiva Samui development is built on freehold land with full legal title and access rights and is free of any mortgages or legal encumbrance. As a foreigner, Thai law does not currently permit you to own freehold land. We have therefore, along with our lawyers created a structure of ownership that gives both the security of freehold ownership without the complications of setting up a Thai Company.

Freehold The land for the development, including all the property, common area and gardens, is freehold and has beneficial legal ownership in the name of Shiva Development Holdings Limited - a none-trading Hong Kong registered company.

As a property owner you are granted preferential shares in Shiva Development Holdings Limited directly proportional to the size of your plot. In addition to this you are also granted a lease with options for 120 years, registered at the Thai Land Office which guarantees both surety of ownership and that no mortgages, loans or liens can be placed on the land.

In the event you wish to sell your villa, this is a simple case of selling the structure along with transferring your shares in the holding company. Should you already be in a position to own land in Thailand or already have your own Thai company we can also provide you with the individual Chanote for your freehold plot.

As with the purchase of any property, we would advise you appoint your own legal representative and if you would like us to assist we can provide you with the names of reputable law firms in Koh Samui.
